Litigation

  • Post Acute Medical at Hammond, a hospital that qualifies as a provider of services under the Medicare Act, filed Tuesday in U.S. District Court for the District of Columbia challenging a rule promulgated by HHS that reduced Post Acute’s reimbursement amount for services provided in 2016. Post Acute claims that the rule violates the Administrative Procedure Act and the Medicare Act because it is arbitrary and capricious and was promulgated with insufficient notice. (USCourts.gov)

Legislation & Regulation

  • Yesterday the U.S. Senate passed S.2372, the John S. McCain III, Daniel K. Akaka and Samuel R. Johnson VA Maintaining Internal Systems and Strengthening Integrated Outside Networks (MISSION) Act, called the VA MISSION Act for short, with a 92-5 vote. The bill aims improve the VA’s current healthcare delivery system and help provide veterans with more choice and fewer barriers to care. (Veterans.Senate.gov)

 

  • HHS has released its proposed revisions to Title X regulations, emphasizing compliance with the requirement that none of the funds appropriated for Title X may be used in programs where abortion is a method of family planning and related statutory requirements. (HHS.gov)

 

  • Gary Cantrell, Deputy Inspector General for Investigations of the Office of Investigations at the DHS OIG testified yesterday before the Senate Special Committee on Aging on "Preventing and Treating Opioid Misuse Among Older Americans." Cantrell stated: "OIG has made combatting the opioid crisis a top enforcement and oversight priority. We will continue to leverage our analytic, investigative, and oversight tools, as well as our partnerships in the law enforcement and program integrity communities and with the Department to maximize our efforts." Medicaid

  • The state of South Dakota is seeking comments on draft proposal of a five-year pilot program called the Career Connector program that would implement Medicaid work requirements in its two most populated counties. (DSS.SD.gov)

Private Sector

  • Anthem, Inc. announced yesterday that the company has entered into an agreement to acquire Aspire Health, the nation’s largest non-hospice, community-based palliative care provider. The acquisition is expected to close in the third quarter of 2018. (AnthemInc.com)
